Disposition Authorities for Individual Classifications for Headquarters Case Files. Part B: Classification 156. Employment Retirement Income Security Act.

The FBI established this classification on December 30, 1958, for cases involving the Welfare and Pension Plan Disclosure Act of 1958, which required filing pension plans with the Department of Labor. During the summer of 1962, as a result of expanded legislation, the Department of Labor acquired additional authority to examine the books relating to pension and welfare plans. The Department of Labor requests the FBI to investigate instances of embezzlements and kickbacks it has uncovered. With the adoption of the Employment Retirement Income Security Act (ERISA), effective on January 1, 1975, and by subsequent agreement with the Department of Labor, the Bureau investigates kickbacks, false statements, embezzlements, interference with rights, and prohibitions against holding positions, and the Department of Labor investigates failures to report and other matters.

The FBI established this classification when it assumed responsibility for ascertaining the protection capabilities and weaknesses of defense plants. Each plant survey was a separate case file, with the survey, supplemental surveys, and all communications dealing with a plant insofar as plant protection was concerned, filed together.
